1. OVERVIEW

Your use of Histropedia is subject to these terms and by using Histropedia you agree to them. Generally we do not monitor or delete content and exercise no editorial control over Histropedia. Our role is therefore to host the service and to make it available to you to decide how to use. Histropedia does not endorse any information provided by our service and we make no representations or guarantees as to the truthfulness, accuracy or reliability of any content used or submitted.

Histropedia is intended for general information purposes only and is intended to be used by you for your own personal use.

As Histropedia grows and we add more capabilities and functions we may need to expand on these terms. If we do so we will give you adequate notice of this and if you continue to use Histropedia then you will have signified your acceptance of the updated terms in doing so.


2. LICENCES

2.1 Text

The majority of text contained within Wikipedia articles is licensed under the Creative Commons Attribution-ShareAlike 3.0 Unported License (CC-BY-SA) or the GNU Free Documentation License (GFDL).

Below is a broad overview of the main freedoms and restrictions on content published under these licences, but please follow the links in the previous paragraph for full details on their scope.

In short, you are free to:
SHARE —to copy, distribute and transmit the work, and
REMIX —to adapt the work

Under the following conditions:
ATTRIBUTION — you must attribute the work in the manner specified by the author or licensor. A link to the relevant Wikipedia article is sufficient attribution.
SHARE ALIKE— if you alter, transform, or build upon this work, you may distribute the resulting work only under the same, similar or a compatible license.


2.2 Images

The images displayed on ‘Event Cards’ in Histropedia have been automatically extracted from their corresponding Wikipedia articles. Each image is loaded via a URL which specifies the images location on the web, so image data is not stored on our servers.

Each Event Card image can be located within the Wikipedia article the event is linked to. Clicking on the image within the Wikipedia article will navigate to its image description page on Wikipedia. Here you will find the licence it has been published under, along with the copyright status and any special instructions that the copyright holder has provided regarding re-use of the image. The image description page also includes other important information, such as the author of the image, the source, and the file’s revision history.

Please be aware that neither Histropedia Ltd nor the Wikimedia Foundation provides any warranty regarding the copyright status or correctness of licensing terms. If you decide to reuse any images found on Histropedia, you should verify the copyright status of each image.

2.3 Timelines

By creating any timeline using Histropedia, you are agreeing that your timeline is licensed under the http://en.wikipedia.org/wiki/Wikipedia:Text_of_Creative_Commons_Attribution-ShareAlike_3.0_Unported_License Creative Commons Attribution-ShareAlike 3.0 Unported License . Broadly speaking, this just means that your timeline may be adapted and/or re-shared by any other user. Please follow the link for a complete description of this license. The same would apply to any changes made by you to other timelines (if and when this becomes available as an option).


3. COPYRIGHT

3.1 Text

All article text on Histropedia is displayed directly from Wikipedia and hence has a copyright status defined by the terms that Wikipedia editors have agreed to when creating or editing Wikipedia articles.

The text of Wikipedia is copyrighted (automatically, under the Berne Convention) by Wikipedia editors and contributors and is formally licensed to the public under one of several liberal licenses (see http://en.wikipedia.org/wiki/Wikipedia:Copyright for full details).

The reuse of any Wikipedia text viewed via Histropedia is permitted under the same terms as direct use from Wikipedia. So any reuse must comply with the conditions set out by the author of the work, or in the licence that the content was published under.

It is the users’ responsibility to check the licence and copyright status of any content they wish to reuse.


3.2 Images

You can view the copyright status of any image found in Histropedia on its corresponding image description page, which is accessed by clicking on the image where it is displayed in the Reading Window.

Please be aware that neither Histropedia Ltd nor the Wikimedia Foundation provides any warranty regarding the copyright status or correctness of licensing terms. If you decide to reuse any images found on Histropedia, you should verify the copyright status of each image.

3.3 Event Dates

Given the nature of copyright law generally we do not believe that the creation of individual date points or adding individual events would in themselves attract copyright protection. Nonetheless, to the extent that they would be subject to copyright protection you agree that they will be subject to the Creative Commons Attribution-ShareAlike 3.0 Unported License.


3.4 Reporting Copyright Infringement

If you believe that any content on Histropedia constitutes an infringement of intellectual property rights of a third party (including copyright or trademarks) or the applicable licence terms, then please email us at copyright@histropedia.com.

You should include the following information in your email:

  • Details of the copyright owner and if that is not you on what basis you are authorised to act on behalf of the copyright owner (the “complainant”).
  • A description of the copyrighted work or other intellectual property that you claim has been infringed (the “offending material”).
  • The location of or territory within which you believe the infringement has taken place.
  • The name or unique identifier of the Histropedia event that the alleged infringement refers to.
  • Your contact information, including your address, telephone number, and email address.
  • A statement by you that you believe the use of the material in the manner complained of is not authorised by the copyright owner or is not subject to one of the exceptions permitted use under applicable copyright law.
  • A statement by you that the above information in your notice is accurate and that you are permitted and/or authorised by the copyright owner to make this complaint.

Upon receipt of your complaint we will investigate it.
Upon receipt of a complaint it will be forwarded to person or persons who created or posted the offending material (the “creator”). It will then be up to the complainant and the creator to resolve the complaint between them.

If you are unable to do so within 30 days and we have received no further communication from the complainant then we may reinstate the offending material. Histropedia will comply with any reasonable request from the complainant and the creator reached as a result of any resolution of the dispute.

Histropedia may, in its sole discretion:

  • simply remove the offending material,
  • remove the offending material and post either full details or a summary of the dispute,
  • leave the offending material as it is but post either full details or a summary of the dispute, or
  • do nothing and await the outcome of the dispute.

If you are the creator of the offending material then you agree that we may remove it pending resolution of the complaint (but are not obliged to do so). Both parties to this complaint agree that our removal of the offending material is not an admission of liability in any way nor does it indicate that Histropedia has accepted the complaint.

Histropedia will comply with any courts orders received by it.

By invoking this complaints procedure the complainant agree to the above and to hold Histropedia harmless for any reasonable actions it may take and agrees not to hold Histropedia liable for the use of the offending materials. The creator agrees to the above as part of accepting the terms of use of Histropedia.

If the complaint is directed at Histropedia or Histropedia is joined in any complaint then we reserve the right to immediately delete the offending material pending resolution of that dispute.

If you are the owner of the intellectual property rights in any material being used in a timeline and the relevant metadata relating to that material, including the licence under which it is used and released, is incorrect then please amend or correct the metadata and licence used in Wikipedia. As the material is taken from Wikipedia Histropedia adheres to the licence terms ascribed by Wikipedia.


4. PRIVACY POLICY

4.1 Personal Data

Creating a user account requires only an email address, a password and a Display Name. We do not require our users to submit any personal information, nor do we collect any such information indirectly. However, we may on demand require you to identify yourself in full (typically if a dispute arises or there is a complaint). Email addresses are only used to identify user accounts during the log in process, and for sending important notifications to you regarding your user account (such as password reminders).

Your Display Name will be visible to everyone in the revision history of any event or timeline you have contributed to. The revision history also shows the date and time of each edit, and details of the changes made.

None of the information collected about our users will be given to third parties for the purposes of contacting you. We do however collect certain usage information for analytical and performance monitoring purposes (see below) and to identify any abuse of our service.


4.2 Cookies and Local Storage

We use cookies for the following purpose:

Analytics – We use cookies to collect analytics data. This helps us to understand how people use our site, which in turn allows us to continue building Histropedia around the needs of our users.

Individual IP addresses are not recorded so the data collected is completely anonymous and can’t be used to identify any person or computer. If we suspect that you are abusing the service or there has been a complaint made under section 2.4 above then we reserve the right to retain detailed usage logs, including recording IP addresses and any other personal identifiers, so that we may investigate this.



We use local storage for the following purpose:

Saving your current timeline – Histropedia uses local storage to auto-save the content and layout of your current timeline. This has been implemented to prevent accidental loss of the users’ current timeline by navigating away from Histropedia.

You can still use Histropedia if your browser is set to block the use of local storage but the auto-save feature will not be active.

Local storage can be erased at any time by selecting ‘delete cookies’ from your internet browser options. This will remove all saved data, so Histropedia will load to a blank timeline the next time you visit.

Our use of cookies and local storage is solely for the purposes described above. We do not collect any personal information about our users.


4.3 Edits

All edits made are recorded in the revision history, along with the username of the editor and the date of the edit. This information, which includes your Display Name , is available to anyone. If you do not want people to see what you have edited or created then please do not use Histropedia. The log of your edits cannot be deleted or removed. While we will comply with all relevant laws if the “right to forget” is introduced under any data protection and privacy legislation then to the extent that we can opt out of this we will do so and your use of Histropedia is subject to you agreeing to this. The “right to forget” would include any rights to have personal data deleted from social media websites and applications (e.g. deleting an account and all the information associated with it).


5. ACCEPTABLE USE

Your use of Histropedia should convey an accurate and fair representation of any events and information.

You may not :

Harassing and Abusing Others

  • Engage in harassment, threats, stalking, spamming, or vandalism; and
  • Transmit chain mail, junk mail, or spam to other users.

Violating the Privacy of Others

  • Infringe the privacy rights of others under any applicable laws;
  • Solicit personally identifiable information for purposes of harassment, exploitation, violation of privacy, or any promotional or commercial purpose not explicitly approved by Histropedia; and
  • Solicit personally identifiable information from anyone under the age of 18 for an illegal purpose or violating any applicable law regarding the health or well-being of minors.

Engaging in False Statements, Impersonation, or Fraud

  • Intentionally or knowingly post content that constitutes libel or defamation;
  • Post content which is false or inaccurate;
  • Attempt to impersonate another user or individual, misrepresenting your affiliation with any individual or entity, or using the username of another user with the intent to deceive; and

  • Engage in fraud.

Committing Infringement

  • Infringe the intellectual property rights (including without limitation copyrights, trademarks, patents, or other proprietary rights under applicable law).

  • Misuse the services.
  • Post obscene material that is unlawful under applicable law; and
  • Use the services in a manner that is inconsistent with any applicable laws.

Engaging in Disruptive and Illegal Misuse of Facilities

  • Post or distribute content that contains any viruses, malware, worms, Trojan horses, malicious code, or other device that could harm our technical infrastructure or system or that of our users;
  • Engage in automated uses of the site that are abusive or disruptive of the services and have not been approved by Histropedia;
  • Disrupt the services by placing an undue burden on our website or services;
  • Disrupt the services by inundating our websites with communications or other traffic that suggests no serious intent to use the website for its stated purpose;
  • Knowingly access, tamper with, or  use any of our non-public areas in our computer systems without authorization; and
  •  Probe, scan, or test the vulnerability of any of our technical systems or networks unless all the following conditions are met:
  • such actions do not unduly abuse or disrupt our technical systems or networks;
  • such actions are not for personal gain (except for credit for your work);
  • you report any vulnerabilities to Histropedia developers (or fix it yourself); and
  • you do not undertake such actions with malicious or destructive intent.

We reserve the right to exercise our enforcement discretion with respect to the above terms. If we suspect or believe that you are in breach of these terms then we reserve (but do not have an obligation) to:

  • Investigate your use of the service (a) to determine whether a violation of these terms or other applicable law or policy has occurred, or (b) to comply with any applicable law, legal process, or appropriate governmental request;
  • Detect, prevent, or otherwise address fraud, security, or technical issues or respond to user support requests;
  • Refuse, disable, or restrict access to the contribution of any user who violates these terms;
  • Ban a user from editing or contributing or block a user's account or access for actions violating these terms, including repeat copyright infringement;
  • Take legal action against users who violate these terms (including reports to law enforcement authorities); and
  • Manage otherwise the website and services in a manner designed to facilitate their proper functioning and protect the rights, property, and safety of ourselves and our users, licensors, partners, and the public.

We reserve the right to suspend or terminate your account and to deny you access to the service.


6. LIMITATION OF LIABILITY

Histropedia will not be liable to you or to any other party for any direct, indirect, incidental, special, consequential or exemplary damages, including but not limited to, damages for loss of profits, goodwill, use, data, or other intangible losses, regardless of whether we were advised of the possibility of such damage save that we do not limit our liability for death or personal injury. In no event shall our liability exceed five hundred pounds (GBP 500.00) in aggregate. If any applicable law does not allow the limitation or exclusion of liability or incidental or consequential damages, then the above limitation or exclusion may not apply to you, although our liability will be limited to the fullest extent permitted by applicable law.


7. OTHER TERMS

Your use of the services and these terms is subject to English law and you agree to the non-exclusive jurisdiction of the English courts.

Any notices may be served by e-mail or through our website.

If Histropedia does not apply or enforce any provision of these terms then that should not be deemed to be a waiver of that provision.

You understand that, unless otherwise agreed to in writing by us, you have no expectation of compensation for any activity, contribution, or idea that you provide to Histropedia or our community of users.

If any provision or part of a provision of these terms is found unlawful, void, or unenforceable, that provision or part of the provision is deemed severable from these terms and will be enforced to the maximum extent permissible, and all other provisions of these terms will remain in full force and effect.
